Terms and Conditions

This translation is provided for information. In the event of any discrepancy, only the German version is authoritative.

These terms govern the relationship between you and Therawil GmbH. They are deliberately short. If anything is unclear, ask us - we will explain it.

1. Scope and precedence

These terms and conditions apply to all occupational therapy treatments and consultations provided by Therawil GmbH, Zürcherstrasse 66, 8800 Thalwil.

They apply from the first appointment. Anything we agree with you in writing in an individual case takes precedence over these terms.

2. How the treatment relationship comes about

Occupational therapy is prescribed by a doctor. The treatment relationship comes about when a medical prescription exists and an appointment has been arranged.

The number and period of treatments follow from the medical prescription. If it expires and treatment is still needed, your doctor issues a new one.

The treatment relationship is a mandate within the meaning of Art. 394 ff. CO.

3. Registration and consent at reception

Before the first treatment we record your details at reception on a device belonging to the practice. There are two things, and they rest on different bases.

Your registration data - personal details, contact details, insurance and payer, AHV number - is needed so that we can treat you and bill for it. Without them, treatment is practically impossible.

With your declaration of consent you release us from professional secrecy to the defined extent, so that we can exchange information about your treatment with your doctor, your insurer and other professionals involved - limited to what is necessary for that purpose. This consent is voluntary and can be withdrawn at any time, orally or in writing, with effect for the future.

Without release from professional secrecy we may neither speak with your doctor nor handle cost approval and billing with your insurer. Treatment remains possible, but is then billed to you privately, and cooperation with the other parties involved does not take place. Tell us - we will look for a solution with you.

You can take the completed form with you in printed form. On request we will send it to you by email; we will then expressly point out that ordinary email is not encrypted end to end.

4. Our services

A session usually lasts 45 to 60 minutes. We treat according to recognised professional principles and the current state of science. We owe careful treatment, not a particular outcome - the effect of occupational therapy depends substantially on your cooperation and on circumstances no one can control.

We inform you comprehensibly about findings, goal and approach. You decide on every step.

If you cannot come to the practice for medical reasons, we also carry out home visits in Thalwil and the surrounding area on medical prescription. The same rules apply to appointments at your home as at the practice, in particular clause 6.

5. Your cooperation

For the treatment to work, we need complete information from you about your complaints, previous conditions and ongoing treatments.

In addition: the agreed exercises between appointments, as far as you are able; a message if your condition changes noticeably; and a message if your address, insurance or payer changes.

6. Appointments, cancellations and missed-appointment fee

Agreed appointments are binding on both sides.

If you cannot attend an appointment, please cancel it at least 24 hours in advance - by telephone, via WhatsApp or by email. A timely cancellation costs nothing.

If you cancel later or do not attend, we will charge you 80 francs. We charge nothing if we can fill the appointment otherwise; you therefore only pay if we actually suffer a loss.

If you arrive late, we treat you for the remaining time. The appointment ends at the agreed time so that the next patient does not have to wait.

If we are unable to hold the appointment - illness, accident, unavailability of the practice rooms -, we will contact you as early as possible and offer you a replacement appointment. No further claims exist.

A missed-appointment fee is not a benefit of health insurance. It cannot be billed to basic insurance, accident insurance or disability insurance and is charged to you directly.

7. Minors and persons lacking capacity

For minors and persons lacking capacity, the persons with parental responsibility or legal representation conclude the treatment contract. They complete the registration under clause 3, sign the declaration of consent and are liable for the missed-appointment fee under clause 6.

Minors capable of judgement take part in the decision about their treatment; we involve them in a way appropriate to their age.

8. Costs and billing

Occupational therapy is a benefit of mandatory health insurance. Basic insurance covers it when a medical prescription exists. What you pay yourself depends on the deductible and co-payment in your policy.

If the treatment follows an accident, the accident insurer covers it; if you are registered with disability insurance, the IV does. Billing runs through a Swiss clearing office.

Services that no insurer covers - including the missed-appointment fee under clause 6 - are billed to you directly.

9. Invoices and payment

Invoices are payable within 30 days.

In the event of late payment, we reserve the right to pass collection to third parties. Costs and interest are governed by law.

10. Professional secrecy and data protection

We are bound by professional secrecy under Art. 321 of the Swiss Criminal Code. We pass on information about you only if you release us from that duty, if a law requires it or if the competent authority releases us.

11. Liability

We are fully liable for damage caused intentionally or by gross negligence.

For slight negligence, liability is excluded as far as the law permits. This exclusion does not apply to personal injury.

12. Ending the relationship

Both sides may end the treatment relationship at any time (Art. 404 para. 1 CO). Clause 6 remains applicable to appointments already arranged.

We end it only for objective reasons and will in that case point out ways to continue treatment elsewhere.

13. Changes to these terms

We may change these terms. The version that applies is the one published on therawil.ch when the appointment in question is arranged. Every version carries a date.

14. Partial invalidity

If a provision of these terms is ineffective, the remaining provisions are unaffected. The ineffective provision is replaced by what comes economically closest to its purpose and is legally permissible.

15. Applicable law and place of jurisdiction

Swiss law applies exclusively.

The place of jurisdiction is, as far as the law permits, the registered office of Therawil GmbH. Mandatory places of jurisdiction remain reserved, in particular the place of jurisdiction at the domicile of the consumer party under Art. 35 of the Swiss Civil Procedure Code.
